Compu-Care Terms and conditions
Introduction
Services Overview: Compu-Care is an ongoing product provided to customers by Central Queensland Personal Computers for a period as outlined in these Terms and Conditions.
Acceptance of terms: By submitting payment for a Compu-Care: Bronze, Silver or Gold plan, the customer agrees to the terms and conditions outlined here.
ABN: Central Queensland Personal Computers is a registered Australian business (ABN: 94 452 354 267).
Definitions
Customer: Refers to the individual person who requested and subsequently paid for a Compu-Care Bronze, Silver or Gold plan.
Central Queensland Personal Computers: Refers to the business by which Central Queensland Personal Computers employees are employed.
Central Queensland Personal Computers Employee: Refers to the representative of Central Queensland Personal Computers who provides the service as per the Compu-Care plan requested and paid for by the customer.
Services Rendered: Refers to the services provided by Central Queensland Personal Computers employees to the customer either on-site or off-site. Services Rendered does not include phone contact, email contact, planning or arranging meetings or transport to or from meetings.
Compu-Care Plan: Refers to the ongoing product offered by Central Queensland Personal Computers and purchased by the customer.
Services Provided
Computer Building and Assembly: The designing and building of a custom computer tailored to the customer’s needs as determined by the Central Queensland Personal Computers employee.
Computer Repairs and Troubleshooting: Both hardware and software troubleshooting of problems and errors on or with the customer’s computer.
Computer Maintenance: Work done to and with the customer’s computer to improve or maintain the continued function of the customer’s computer.
Computer Upgrading: Installation of hardware or software upgrades to the customer’s computer.
6-monthly Cleaning and Maintenance: Refers to the service provided to the customer at no additional charge after the customer has paid for a minimum of 6 months worth of Compu-Care products. This service includes but is not limited to the cleaning and removal of dust and debris from the customer’s computer, removal of the CPU-cooler from the CPU socket of the customer’s computer and the cleaning, removal and reapplication of Thermal Compound provided by Central Queensland Personal Computers. This service only covers 3 hours of work and any additional work performed outside of this period incurs fees subject to the Compu-Care plan currently paid for by the customer.
Contact Hours: Services and support are available during normal business hours: Monday to Friday, 8am to 3pm, excluding public holidays.
Customer Responsibilities
Access: The customer agrees to provide access for the Central Queensland Personal Computers employee to their computer or device to access, modify reproduce and/or temporarily impair your data, systems, programs or electronic communications to the extent necessary to carry out the services.
Employee safety: Upon requesting on-site services from Central Queensland Personal Computers, the customer agrees to provide a safe environment in which the Central Queensland Personal Computers employee can work to provide the requested services.
Age, Location and Authority: A customer must be at least 18 years old and located in Australia to request a Compu-Care plan. Central Queensland Personal Computers reserves the right to request identification from the customer at any time.
Fees and Payment
Pricing Structure:
Compu-Care Bronze: $20, starts on the day of payment and lasts until midnight on the 30th day.
Compu-Care Silver: $40, starts on the day of payment and lasts until midnight on the 30th day.
Compu-Care Gold: $80, starts on the day of payment and lasts until midnight on the 30th day.
Payment Terms: The customer’s Compu-Care plan starts from the moment they provide payment for it and continues for 30 days from the day of payment. If, before the end of this 30 day period the customer has not yet paid to continue their Compu-Care service, the service will cease at midnight exactly 30 days from the day of previous payment.
If the customer pays to continue their service, a new 30-day period begins at midnight following the final day of their previous plan. A customer can request to pay for several increments of their Compu-Care service at which point the new cost of the service will be a multiple of the original equal to the number of increments the customer has requested.
Changes of Service: A customer can request to change their Compu-Care plan level at any point. In doing so, the customer’s existing plan will continue until the end of their already-paid period after which, providing the customer has paid for their new level of Compu-Care plan, the new plan will commence immediately on the day following the end of their already existing plan.
If a customer would request to change the level of their existing and already paid-for plan (For example, from Bronze to Silver or from Silver to Gold), Central Queensland Personal Computers reserves the right to determine the price owed by the customer in exchange for changing the customer’s existing plan. The new plan takes effect immediately upon receipt of payment and continues for the already provided period.
Refunds and Cancellations: Central Queensland Personal Computers does not generally offer refunds for change-of-mind cancellations. However, refunds or remedies may be available under the Australian Consumer Law in cases of major failure or if the services are not provided with due care and skill.
Confidentiality and Data Security
Privacy Policy: Central Queensland Personal Computers complies with the Privacy Act 1988 (Cth) where applicable. Personal information collected during service delivery is only used for the purposes of providing and improving our services. Safety Breach Concerns: If, at any time, the customer feels Central Queensland Personal Computers has breached the above clause, the customer may contact Central Queensland Personal Computers to express such concerns. Such correspondence will be the highest priority for consideration by Central Queensland Personal Computers.
Service Level Agreement
Response Times: Customers with an active Compu-Care plan will receive priority service over customers who do not have an active Compu-Care plan. Central Queensland Personal Computers will respond to service and support requests from customers with an active Compu-Care plan at the earliest convenience, subject to availability.
Resolution Times: Resolution times for services and support provided by Central Queensland Personal Computers depends on the nature of the service or support requested.

Limitation of Liability
Service Limitations: While Central Queensland Personal Computers strives to provide the highest quality of service and recommendations, specific results cannot be guaranteed. By using this service, the customer agrees that Central Queensland Personal Computers is not responsible for performance and productivity improvements, third-party software and hardware, data loss, system security and viruses or any such warranties or guarantees.
Project Time Estimation: While Central Queensland Personal Computers will offer time estimates for the completion of a service or product, these estimates are not binding and may not accurately reflect the time required to complete services or products requested. Delays may occur due to unforeseen technical or external factors. In instances as such, Central Queensland Personal Computers may notify the customer of any potential delays but is not bound to do so.
Indemnification: The customer agrees to indemnify Central Queensland Personal Computers against claims arising from their misuse of third-party software or hardware, or from providing inaccurate information that affects service delivery. This indemnity does not apply where Central Queensland Personal Computers has acted negligently.
Termination of Service
Termination by Client: A client may terminate their Compu-Care service at any time. Central Queensland Personal Computers does not provide refunds for terminated services.
Termination by Provider: Central Queensland Personal Computers reserves the right to terminate a customer’s Compu-Care plan if it determines that the customer is not using the service correctly or there is significant risk to any Central Queensland Personal Computers employees while offering the service.
Consequences of Termination: Upon termination of a Compu-Care plan, any relevant discounts for services rendered after the termination are no longer applied. Any months counted toward the 6-Monthly Cleaning and Maintenance service are retained and kept on record for the purpose of recommencement of the Compu-Care service.
Dispute Resolution
Disputes and Resolution: If a dispute arises, both parties agree to attempt resolution through informal negotiation or mediation in good faith. This clause does not prevent either party from exercising any rights available under Australian Consumer Law or from seeking legal remedies where appropriate.
Jurisdiction: Australian Consumer Law: Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have services remedied if they fail to be of acceptable quality.
Changes to Terms
Amendments: Central Queensland Personal Computers reserves the right to amend the terms of this agreement at any time. In the case of amendment, Central Queensland Personal Computers may notify customers with existing and ongoing Compu-Care plans via at least one method of recordable communication e.g. email or text message.
